Terms
These terms set out the conditions for using Tokyo Canvas (the "Game"). By using the Game, you agree to these terms. For how personal data is handled, please see the Privacy Policy.
Purchases, refunds and account handling are governed by the terms of the store you bought the Game from (Steam, Epic Games Store). These terms apply in addition to those.
What you draw
The rights in what you draw in the Game (your "works") belong to you. The operator does not acquire rights in your works.
However, when you publish a work to the gallery, or share one with other players in multiplayer, you must have obtained the permissions needed to do so. If you include someone else's drawing, photograph, character or logo in a work, you need the rights holder's permission both to reproduce it and to make it publicly available (to upload it so that others can receive it). The same applies when you convert the original into pixel art or otherwise adapt it.
Logos and brand marks may be protected as trademarks, and photographs of people as personality or publicity rights, separately from copyright. If you cannot obtain the rights holder's permission, do not publish or share the work.
When you publish a work to the gallery, or share one in multiplayer, you grant the operator a free, non-exclusive right to reproduce, store, transmit and convert the work (including generating thumbnails) to the extent needed to provide the Game. This right is used only to provide the Game, to deal with faults, and to act under these terms. It ends, for the future, when you unpublish or delete the work - but it does not reach copies that other players have already saved as their own data from a work you allowed to be copied.
Prohibited content
When publishing to the gallery or sharing in multiplayer, do not create or publish works containing:
- material that infringes copyright, trademarks, personality rights or any other rights of others
- material that is unlawful or promotes criminal activity
- discrimination, defamation, threats or harassment directed at an individual or group
- excessively sexual or violent material unsuitable for publication
- another person's personal information without their consent
- false information that misleads others
- anything that interferes with the operation of the Game or significantly disrupts other players
Action by the operator
If a report is received, or if the operator considers that a work falls under the above, the operator may delete a published work or make it non-public. Where the matter is urgent, this may be done without prior notice.
If these terms are breached repeatedly, or in serious cases, the operator may restrict access to online features.
The operator is under no obligation to monitor published works continuously.
Reporting
If you own the game, you can also report a work using “Report this work” on its in-game work page.
If you find a work that infringes your rights, or that is unsuitable for publication, please contact:
Please identify the work by its title, author name and ward. If you happen to know the work code (8 characters), including it makes identification certain. A screenshot is also welcome.
For reports of rights infringement, please also tell us what is being infringed, and provide information showing that you are the rights holder or their representative.
Multiplayer
In multiplayer, the canvas of the player who started the session is shared with everyone in it, and what the participants draw is applied to that canvas. Participants can see each other's display names and in-game painter identifiers.
Please do not disturb other players, including over voice chat.
External services
The Game uses Epic Online Services for its online features. Use of those features is subject to the conditions set by their provider.
If you load an avatar through the VRoid Hub integration, your use of that model is subject to the conditions set by VRoid Hub and by the model's author. Rights in the model belong to its author.
Changing and ending online features
The operator may change, add to, suspend or discontinue the Game and its online features, in whole or in part, at any time, for any reason and without prior notice. The operator will try to give notice in advance where that is possible, but is not obliged to do so.
The operator does not provide compensation or refunds for any loss arising from a change, suspension or discontinuation of online features. Purchases and refunds are governed by the terms of the store you bought the Game from.
If the online features the operator provides are discontinued, the parts of the Game that do not need them remain usable.
Your data
Save data is stored on your device. Works published to the gallery are stored in the cloud, but the operator does not guarantee the preservation of any of this data. Please keep your own backups of anything important.
Disclaimer
The Game is provided as is. The operator does not warrant that it will be available without interruption, that it will be free of errors, or that it is fit for any particular purpose.
To the extent permitted by law, the operator is not liable for damages arising from use of the Game. Where the operator is liable, it is not liable for lost profits, lost data, business interruption or any other indirect, special or consequential damage, and its liability is limited to the amount you paid to purchase the Game. This limitation does not apply where the operator acted intentionally or with gross negligence.
Disputes between players, and disputes arising from works published by players, are to be resolved between the parties concerned. If the operator receives a claim from a third party, or suffers loss, because you breached these terms, you are responsible for the resulting costs, including reasonable legal fees.
Changes to these terms
These terms may be changed as necessary. Changed terms apply from the time they are published on this page.
General
If any provision of these terms is held invalid or unenforceable, the remaining provisions stay in force.
If the operator transfers the business relating to the Game to a third party, it may transfer its position, rights and obligations under these terms to that party.
If you are a minor, please use the Game with the consent of a parent or legal guardian.
Governing law and jurisdiction
These terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to the Game.
In the event of any discrepancy between this English text and the Japanese text, the Japanese text prevails.
